1. Acceptance
These Terms govern the use of the Pyltex website, customer portal and services. By ordering, paying for or using the services, the company you represent (the Customer) agrees to these Terms and to ourPrivacy Policy. If you do not agree, do not use the services. You confirm you have authority to accept these Terms on the Customer’s behalf.
2. Who we are
Pyltex. Contact: hello@pyltex.com.
Pyltex provides its services to businesses only. They are not offered to consumers.
3. The services
Pyltex provides business phone lines (extensions), phone numbers, call recording, messaging, AI features such as call summaries and AI agents, and ready-made tools such as quote engines, workflow bots, connectors and managed hosting, as agreed with each Customer (the Services). The Services the Customer has contracted, and their quantities, are shown in the customer portal. We may improve or change features over time without reducing the core of what the Customer pays for.
4. Accounts
Access to the customer portal is by invitation, with a sign-in link sent by email. The Customer keeps its users’ email accounts secure, tells us promptly of any unauthorized access, and is responsible for what happens under its accounts.
5. Prices and billing
- Subscriptions are billed monthly in advance, in US dollars, by card, through our payment processor, Stripe. Your card details are handled by Stripe and never stored by Pyltex.
- The monthly amount is the contracted quantities at the prices shown in the portal before payment.
- Usage beyond what is included (such as extra minutes or AI analysis) is billed at the end of the month in which it was used, at the agreed rates.
- A one-time setup fee applies only when the Customer needs configuration work, and is agreed in advance.
- Prices do not include taxes. Each party is responsible for the taxes that apply to it under the laws of its country.
- We may change prices with at least 30 days’ notice by email. The new price applies from the next billing period after the notice period.
6. Failed payments
If a payment fails, we will notify the Customer and retry it automatically. The Services continue while we retry. If the payment is still unsuccessful after 14 days, we may suspend the Services until the outstanding amount is paid.
7. Cancellation and refunds
- There are no long-term contracts. The Customer can cancel at any time from the customer portal or by email.
- Cancellation takes effect at the end of the period already paid. The Services remain available until then, and no further payments are taken.
- Payments already made are not refunded, including for partially used months.
- Usage billed in arrears up to the end date remains payable.
8. Your phone numbers
Phone numbers assigned to the Customer remain the Customer’s. If the Customer wants to move them to another provider, we will cooperate with a port-out request made before the Services end, subject to the rules of the carriers involved. Numbers not ported out may be released some time after the Services end.
9. Acceptable use
The Customer and its users must use the Services lawfully. In particular, they must not:
- make calls or send messages without the consent the law requires, including under the US Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act and carrier messaging rules;
- send spam, run robocall campaigns or spoof caller ID;
- use the Services for fraud, harassment or any illegal activity;
- try to break, overload, reverse engineer or gain unauthorized access to the Services or other customers’ data.
We may suspend the Services immediately if their use puts carriers, other customers or Pyltex at risk.
10. Call recording and customer data
- Some places require the consent of everyone on a call before it is recorded. The Customer is responsible for giving any notice and obtaining any consent required to record, transcribe or analyze its calls and messages.
- The Customer owns the content of its calls, messages, recordings and contacts (Customer Data). Pyltex processes Customer Data only to provide the Services and on the Customer’s instructions, as described in ourPrivacy Policy.
- Unless agreed in writing, the Services are not designed for regulated health information, and the Customer should not use them to process it.
11. Emergency calls
Internet-based phone service depends on a working internet connection and power, and emergency calls (such as 911) may not work or may not send the correct location. The Customer must make sure its users know this and have another way to reach emergency services.
12. AI features
Summaries, transcripts, suggestions and replies generated by AI may contain errors. The Customer should review them before relying on them for important decisions.
13. Availability and support
We work to keep the Services available and to fix problems quickly, but we do not guarantee uninterrupted or error-free operation. Planned maintenance is scheduled, when possible, outside business hours. Support is available at hello@pyltex.com.
14. Intellectual property
Pyltex and its licensors own the Services, the website and their software and content. While the Customer’s subscription is active, the Customer may use the Services for its own business under these Terms. Feedback the Customer gives us may be used to improve the Services.
15. Third-party services
The Services rely on carriers, cloud providers and other third parties, and may connect to tools the Customer chooses, such as its CRM. We are not responsible for third-party services the Customer connects, or for outages of carriers or networks outside our control.
16. Limitation of liability
To the extent permitted by law, Pyltex is not liable for indirect or consequential losses, such as lost profits, revenue, data or business opportunities. Our total liability arising from the Services in any 12-month period is limited to the amounts the Customer paid us in that period. These limits do not apply to fraud, wilful misconduct, gross negligence or anything that cannot be limited by law.
17. Indemnification
The Customer will cover Pyltex’s reasonable losses and legal costs arising from claims by third parties caused by the Customer’s breach of these Terms or unlawful use of the Services, including calls, messages or recordings made without the required consent.
18. Term and termination
These Terms apply while the Customer uses the Services. We may end the Services with 30 days’ notice, or immediately for a serious breach of these Terms, such as unlawful use or non-payment after suspension. After the Services end, the Customer may ask for an export of its Customer Data within 30 days; after that, it may be deleted.
19. Changes
We may update these Terms. For material changes we will give at least 30 days’ notice by email or in the customer portal, and the Customer will be asked to accept the new version before its next payment. Continuing to use the Services after that means the Customer accepts the changes.
